How much tax do I have to pay on a succession?
Last update: 10/3/2012
None, inheritance tax was repealed on 25 November 1992.
It should be noted that stamp duty must be paid for certain properties. This includes immovable property situated in Malta and shares in a private Limited Liability Company which was set up in Malta. For the abovementioned immovable property and shares, the tax rate is generally 5 percent of the value of the property in question.
Detailed information
How much inheritance tax?
Tax is only due on immoveable property and on the value of shares in companies not quoted on the Malta Stock Exchange. The maximum rate of tax on immoveable property is 5%. The maximum tax due on the value of shares is also 5%.
No tax is due on other assets of the estate.
Can the estate be subject to taxation in one or more Member States? Are there double taxation agreements?
In Malta, the tax paid on inheritance is not succession tax but Stamp duty on immoveable property and shares as mentioned above. It is possible that if the deceased is not domiciled in Malta, tax will be levied in his/her country of domicile. This is the case for the U.K.
