What is the amount of the death duties payable?
There are 2 different situations in which duties are payable in the Grand Duchy of Luxembourg:
- If the deceased was a resident in Luxembourg, the estate will be taxable in the Grand Duchy of Luxembourg (except for property located abroad) on the basis of death duties;
- If the deceased was not a resident in Luxembourg, transfer duties will be levied on assets located in the Grand Duchy of Luxembourg.
Can the inheritance be subject to taxation in two or more different States? Are there double taxation agreements?
Yes, and to date, the Grand Duchy of Luxembourg has not concluded any double-taxation agreements covering death duties but to overcome any double taxation, law-makers in Luxembourg have provided for unilateral tax measures to prevent double taxation of either personal property or real estate.
