How and when does one become an heir?
Last update: 10/3/2012
The succession does not need to be expressly accepted. If the deceased lived in Finland, the heirs must draw up an inventory of the estate within three months after death. Then, the deceased’s debts are settled and the rest of the estate is shared. The estate does not devolve to the heir following death, but only within the framework of the division of the estate.
Detailed information
When and how does one become an heir?
The status of heir stems from the law. The deceased may make bequests, the implementation of which is suspended until acceptance by the beneficiary while the testator is living or after his/her death.
Is it possible to renounce a succession?
It is in principle possible to renounce a bequest without respecting a time limit, unless the beneficiary has previously accepted it (in a conclusive manner).
Is it possible to accept a succession subject to conditions?
Finnish law expressly provides for the renunciation of an inheritance, subject to conditions.
Are the heirs and co-heirs liable for the deceased’s debts?
The heirs are only responsible for the debts up to the value of the assets of the estate (21 PK).
